Bank of America was hit today with a class action lawsuit by major securities plaintiff firm Robbins Geller Rudman & Dowd on behalf of Pipefitters Local No. 636 Defined Benefit Plan in U.S. District Court in the Southern District of New York.
The plaintiff alleges that Bank of America concealed information that they were inadequately staffed to handle the large volume of foreclosures in its mortgage portfolio. They also allege that Bank of America concealed billions of dollars in debt from its publicly reported balance sheet.
While there is a lot of litigation from homeowners against banks alleging unfair or illegal foreclosure processing practices, this lawsuit takes a different angle by targeting the bank from a securities fraud perspective. We’ll continue to follow this story as it unfolds.

I have had many problems with BOA. What do I need to do to join the class action suit? They are horrible. I finally got approved for modification and was sending payments for almost a year and then I get a letter telling me my modification was not approved and I would have to start proceedings all over again. On top of sending my payments, I was constantly getting letters to foreclose on my property. One department doesn’t know or keep in touch with the other departments.
It’s a good thing I have the legal service that I have and they were able to advise me. But I would still like to join the suit.
I understand your frustration–I started a loan mod process in Dec 2009–October 2010 we were denied–applied for a deed in lieu in Oct 2010 and was finally approved in Nov 2011- I folowed all of their requirements and signed all documents sent by their attorneys and now BAC tells me the deed in lieu was not valid. Good luck my next step is to seek an attorney to file a suit against BAC

I need to find a class action lawyer or law suit in Colorado against Bank of America. It should be illegal to ruin peoples business and lives.
Let me know if you find out anything that can be done against BAC. They are so cold-blooded and unethical. They are currently trying to screw us out of our loan modification as well as our home. We followed all of their requests, and then some, yet they still want to forclose if we can’t pay 12 months interest plus fees within 3 weeks notice. I have a 3 year old son and a wife who just got her citizenship. We don’t plan on leaving, but if we’re forced to, it surely won’t be quietly.

Go to a legitimate HUD Counselor immediately, before you are foreclosed on. You can file a forbearance- Immediately, this will delay any foreclosures , but not permanently. They can recommend a local legitimate lawyer to assist.

in order to stop the foreclouser of your home, you must do an audit of your mortgage. There will be a feww errors in the paperwork, and that will mean the mortgage is not valid and the court will order boa to redo the whole mortgage and it will be as if you just got the mortgage. also if your mortgage was purchase by boa from another company, boa must show in court that they did purchase the mortgage for the other lender by a transfer of total funds for the loan, and if they cannot prove the bought the loan, than they cannot close on you.

If you find some one in Illinois, count me in on a class action suit since I have been dealing with BOA for almost two years. They promised me a trial mod in Feb 2011, I made the first payment April 1 as required and they called me to tell me that I no longer qualified for a mod? What???? They can stick it now.

I really need to know if anyone knows how to get BofA. I was a First Franklin client, until BofA bought them out. I did my three trial payments, was told that I would get my final documents, then that’s when I was transferred to BofA. They lost ALL of my MHA documents during the transfer. I dealt with them for over 2 years too. Been given the run around, and been told so many different stories. I even kept paying them on time every month. Now, I am told I got denied for the Making Home Affordable, because I did not complete my three trial payments. DID THEY LOOSE their minds? We are in WA state Bank of America took over our mortgage when Country Wide went under. Since we had fallen behind for several years now (we’ve tried to get cy would caught up by borrowing from our 401K) we have one year paid up what they said with our tax return – and we are now at this pt 7 months behind. We have been told in past loan mod was just about done – but nothing. we were told to give a huge chunk and they would put all late fees at end of loan – they lied. now we have supposedly one person working on our loan mod since they are sending BOA workers all over map (we met them at the convention center in Portland in OCT) I want to be hopeful but it seems like a big runaround. Im ok to let the house go but my husband is not. I feel like we are drowning in this house – we were desperate to get into a house when our little boy was diagnosed with brain tumor – but like so many Americans today we owe 260,000 for a home that isn’t even worth it. It would be fine if they would do what they say they are gonna do – at one pt she said if it goes over 12 months they dont do mods but short sales – i right away said I’d do a bankruptsy first before a short sale – then the gov says we made a profit and we owe all that extra in taxes! Americans who are not the elite are being taken for a ride. from all I have read of other’s experiences, the bailouts and makingn home affordable seems to be a smokes creen. the only thing that keeps me from not losing sleep is living in WA they cant come after you for the remainder if it forecloses. Is there a similar class action in North Carolina? How to file one? BoA did this same thing to us – promised to consider modification, then asked for months to re-fax paperwork ’cause allegedly not all pages were received by them, in the mean time their collections people kept calling us daily. We kept making payments under modification agreement for over a year until one day we were served with a foreclosure notice. So we called B0A and their reps said that as soon as we pay off the money we supposedly owe, BoA would remove negative comments from our credit reports. We promptly borrowed money from relatives, sold a few things around the house and paid them off (even though all the while we continued making agreed-upon reduced mortgage payments). Months later the negative comment is still on all three credit reports, damaging our credit. BoA refuses to take it off now. And getting it disputed with the credit agencies is no use since they all rule in favor of B0A. Now we can’t even refinance! What a scam!!!
Happen to me also, but I refuse to make a single payment until they modify the mortgage. It;s now 10 months and after demanding they take me to court, because i can show they violated the mortgage agreement, they now sent me a new mod agreement app. For eight month’s they kept asking for more paperwork, week after week and telling me they are working on the mod, but I knew they only want to make sure you stay in the home to keep it up while they sort out the forecloser fraud they were cort up in with the phoney sigs on the court papaers they submitted to courts. Be prepaired to fight them with an audit of the mortgage you signed with them. Also the must prove in court that they purchased the loan with cash funds from the bank, meaning they cannot go into contract with you if they cannot prove they owned the property…….THEY WILL LOSE IN COURT!!! YOU WILL NOT HAVE TO MOVE OR MAKE ANOTHER PAYMENT TO THEM FOR THE HOME!!
ALSO THEY MUST HAVE ALL ORIGNIAL DOCS WITH YOUR SIG ON IT…IT CANNOT BE A PHOTOCOPY, THEY MUST BE THE ORIGNIAL!

My husband died and his life insurance had been cancelled less than three weeks prior to his death due to his health (another battle) which is why I’m in this situation. The home is in MI and has not yet gone to foreclosure, however I haven’t made a payment in 14 months. The original loan was with Quicken, then Countrywide, then BOA–my husband did everything to secure it, so I’m not even sure where to start with this. I’m at my wits end after trying to qualify for a HAMP loan mod, which after 8 months of jumping through hoops has fallen through due to the financial docs not being in my file–so they say–in reality, they’ve been sent in three times throughout the process. I have been following up with them several times a week since the beginning, staying on top of everything. After reading everything on here, I realize that there is no winning with this company. I work full time as a flight attendant and am based 1500 miles from home and gone three weeks out of every month. That coupled with the fact that financially I’m operating in the red, has made this whole process especially challenging.
Did you write BoA a hardship letter? Have you resolved anything with them? We are in the same position, my husband has MS and lost his job and we now have the house on the market since we can’t make a payment. Now we are doing a short sale but I dont know if BoA will accept that when an offer is made. We have tried since Nov. of 08 to get a loan mod while we were both working. Now it’s too late! I hope this is good news for us!! We have been in the so called modification program since. 2009 only for them to now say we owe $19,000. We have always made the payment every month. We also have been told dont send more than the trial payment you will goof everything up.

She told me they will take all we owe and make a new 30 year mortgage – and they set up trial payments to make sure we keep up with it.

I too, am looking for a class action lawsuit against Bank of America. Instead of taking the payments I was making and applying them to my payments, they put the mortgage payments to the principle of my loan, after talking to everyone at BOA, my city office of BOA was able to have them reverse the payments. Now however, because they had already started the foreclosure process we had to send them 5388.28, to stop the foreclosure. We sent the payment to the lawyer, who sent the payment to BOA, who lost the check. The attorney reissued the check after stopping payment on the original… they resent another check on may 9, 2011…… guess what? BOA lost the check again. Please someone find a class action lawsuit for me in the state of Virginia. I have all my documents, notes when, where, what time and who I have talked to not to mention scores of other documents showing the mismanagement,of my loan, and just plain inept procedures at BOA.

That happened to my husband and I back in July of last year. I lost my job of 6 years in which I was bringing home the big part of the money to pay our mortgage. We contacted BOA right away and the lady told us to just pay payments here and there until we have a full payment in to apply to our July payment….She also told us not to modify our mortgage as it takes forever and it won’t help…BS! Well we paid our July’s payment and they did the same to us…they applied it to Principle and not to our loan payment WTF! I spoke to two different people over there and the last guy told me (after I asked 3 times to make sure) that he was applying our payment to July….Um never F-ing happened! I hate BOA and they have nothing but dumba**es that work there which whom doon’t care about anyone but themselves! We ended up hiring a lawyer to do our modify back in October last year. They work with everyone on a payment plan to start the process (which is easy to pay). Even with a lawyer on your side BOA still can’t get crap right and oh they have lied to our lawyer a few times on our process! It is now July 18, 2011 and we still are waiting for an answer on our home modify from BOA since they dicked around for so long (which I believe they do this on purpose so you do go into foreclosure)! We also have a FHA loan which sucks because we have to pay our regular mortgage payment just to keep us at 12 months behind until this process is done UGH.

While waiting for the approval of a modification, the payments that I made were put towards the lawyers fees, etc. I requested a copy of my loan with my wet ink signature and received partial loan papers with two DEED OF TRUST : Both have my state and county. But on one of the DEED OF TRUST -The loan company scratched through my state and county and put their state and county(California) and signed it and circled and scratched out part of the paragraph. I am in Mississippi.

After a year and a half of faxing in countless amounts of paperwork,speaking to literally 40-50 different people at BOA,AND being told they never received requested paperwork or”maybe it went through to the wrong department”!!!! I was finally told (after i called them…as i usually did… because they were so awful with correspondence) that i had been denied a loan modification,and my home is now in foreclosure!!!!! I’m absolutely amazed at how haphazard they conduct their business. Talk about the ‘left hand doesn’t know what the right hand is doing’!!!! I became so frustrated speaking with them on the phone,always someone different ALWAYS giving me a load of information contradictory to the person before….that i thought i’d have a nervous breakdown…they literally drove me crazy!!! If you have BofA say a prayer!!! I had them and could not stop it. I had documents show I had a modification with them in Oct 09. Made payments on time for 14 months on the 15 month got a forecloser notice had 1 month to move out. Spent hours on the phone with them transfered from one person to the next. Ended up moving out a week before the sale. They made money on me!! Now get this they call me just the other day. Said I have a line of credit with them from the house. The house was foreclosed on in April. In June they call the first time and would like to set up payment plans!
seriously, this makes me SICK! i’ve dealt with them and i feel your pain! i’m in the process of moving due to foreclosure… dealing with them is a NIGHTMARE…
You wont lose your home. In fact you can own it since you mentioned the magic word “they lost your mortgage note”. Understand, without a mortgage note, there cant be foreclosure and without the note, the mortgage is void. Do a silent securitization audit. Get a company that will do this and you will be so shocked to find out that the reson for a run around is due to them not having your orginal mortgage note.
You see when BOA purchased loans from CountryWide, they combined many loans as a security and sold to investors (called securitization). So, technically, the investors own your loan/mortgage and not BOA. And, when a judge in California I think it was, asked for the orginal note, BOA can’t produce the note. The judge then told their representative there cant be foreclosure without the note. And this opened up a can a worms. For those who dont know the law, THERE CAN’T BE FORECLOSURE without the ORGINAL NOTE.
You shouldn’t worry. Just know if you have been fighting for modification and getting a run a around is because they don’t have your mortgage note. That is all, otherwise you would have been foreclosed on a long timd ago.

I am in the foreclosure process with BofA in Louisiana and would like to join a class action suit. Loan started out with Countrywide in 2008 as an ARM; Once my income fell off in 2010, I started working with them on loan mods, but got no where (of course) and spoke to dozens of people. i have a long line of things like all of you do..my thing is 2 years ago i was sent a letter saying that one of their employees found my whole file,all my information,my ss and everything about me and SOLD it to a 3rd party..all they said is i hope this hasn’t been an inconvenience to you…so sorry…thats it!!….i am disabled,i have no place to go if they foreclose on me..they said for a long time that they would modify my loan but hasn’t happened…..anyone know of anything i could do???
same story… tried relentlessly for 18 months to get a mod due to divorce and being laid off. i was given the run-around, never told the same thing twice! i sent them EVERY document that they requested, and inevitably they would say they didn’t recieve it (even though I would have email documentation stating that they did). it was a complete nightmare!! i have been reduced to tears numerous times dealing with these people… finally i gave up and tried to just shortsale the house, we got an offer the same day we listed it… BOFA didn’t even view the offer, instead they immediately foreclosed on the house. so, as of last week, i don’t own my home. my four children and i are looking for housing. this should have NEVER happened. i qualified on EVERY level for a MOD under the MHA program! they are supposed to lower the intrest, amortize the loan out 40 years from today… whatever it takes to LOWER the monthly!! it’s so frustrating to know that someone else will purchase “my home” for an amount that i COULD AFFORD!!!

You are exactly right! Fannie Mae bought our house on the “court house steps” which was already planned. Fannie Mae distributed the gov. relief $ to B of A and other banks which were suppose to use that $ to help homeowners and did not. B of A paid our mortgage insurance thru our payments which automatically made us ineligilbe for a mod (B of A changed this prior to all modification possibilities how clever of them!) All along while dragging this out making us look further and further behind they knew we would not qualify. Foreclosing on our home meant B of A would collect mortgage insurance for current loan amount and also “sell” it to Fannie Mae and collect again on our home! B of A , Fannie Mae and the Government are all in this together! I wonder if B of A is the government or just legallized criminals!
I was denied a modification twice for making more than 30% of my mortgage in gross income. They make you fill out your entire financial history but none of it counts. They could care less if you have a hardship, all that matters in the end is how much you gross on paper. They finally set a sale date and the notice stated that they needed to recover around 106K which was my balance plus fees. The home was sold for 119K and BoA was listed as the buyer. Now 4 months later, a collection agencey is trying to collect 15k for a deficiency balance on behalf of Fannie Mae. How is this possible since my mortgage was not government backed and I had been dealing with BoA through the whole process? Fannie Mae was never listed on any documents.

I looking for a class action suit in Idaho. I have been trying to get a loan modification for 18 months. In order no to lose my home I did a partial reinstatement. They have been telling me for the last 3 months that I am in the final stages of a loan modification, and just found out yesterday that since May 6, 2011 they have not even worked on my modification even though they told me I was in the final approval process. It has been one lie after another. The B of A also told me my loan was going to be referred to another bank, but I found out this was not true. I have so many hours in this with no real help at all. The entire program is a farce. I would like to sue them, but do not have the funs, so if there is any class action suit I can join this is what I would like to do. I started my process with B of A in 2009, and I am now back to zero. they had my financials also mixed up. I have never seen anything like this.

We were told we could refinance the high interest loan in 12 months after the sale of our 1st home. We sold 1 month later. My husband is in construction and is laid off several times a year for a few weeks. We have been trying to refinance or loan modification or anything we can and getting different answers everytime we call. I have documented everything. Also in Idaho and would like to join a class action against B of A. Our home is in foreclosure after they misapplied payments and sent payments back. I have the money to pay in current. Now trying to get reinstatement figures is a f***ing joke! They are charging illegal amounts, telling me not to deal with the Trustee (that they hired, and according to one loan specialist supervisor, they dont know), and delaying any reply to my requests. I seems they are going to keep this up until I DONT have enough money to reinstate. Dont know if I should use the money I have to pay them or a lawyer. Additionally their lawyer and trustee are in WA and obviously have no knowledge of Idaho law, but where can you get help in making them OBEY the law? We entered a loan mod agreement with Bank of America and paid them 15,000 up front and agreed to pay 2500 a month for 6 months to show we were able to make the payments on time. We paid for 8 months and then they finally said we were approved and they would fed x all the paperwork for us to sign. We never got the paperwork and then when I could finally get through to a real person I was told we were NOT approved because we were on an interest only loan . (We were on a regular conventional fixed rate loan.) We had even received a letter from them after the 8 months of payments thanking us for bringing our loan current! Our file was sent to the foreclosure attorney again and despite all the payments and all the phone calls and the fact that we paid over 70,000 AFTER they first filed the foreclosure suit, we still lost our home and 77 acres! They gave us no notifications and even had the Sheriff’s sale while we were making payments to them. They sent a local realtor to our property and seized 9 of our horses and had them hauled away and sold before we even had time to move them. I had called attorneys but no one seemed to know how to help. They just took money and basically did nothing. Our property was worth three times what we owed them. After seeing how many thousands of other people that have had similar experiences with them it makes me sick at what they get away with. ( a year after we lost our home they were still sending us letters saying our loan had been transferred to another lender and even gave us a new loan number.)

To Whom Ever This May Help.. I was in the same situation as a lot of you folks. I was a year and a half into my fight with BofA (Bunch of Assholes) I finally got the idea to contact my State Attorney General.. I live in Maine and I contacted Linda Conti. She got involved and 2 months later (2-2-2011) I had a modification with 2% interest and in 8 years it goes up to 5%, but can never go higher. We received a 2nd modification package on 10-27-2011, repairing the screwed up first modification (where they were bilking us out of $16,000) Now we find that on February 2, 2012.. they have REMOVED ALL of our payments back to April 1, 2010 and sent us a Notice of Intent to Accelerate (foreclose) saying we owe $14,446.67… I sent an email back to Linda Conti last night (2-13-2012) and this morning (2-14-2012) I got a reply back from her saying that she was going to call them to find out what is going on. At 1pm today (2-14-2012) I got a phone call from BofA , my new loan manager, stating that she will do everything in her power to find out WTF is going on. so I will give her the benefit of the doubt and wait for her response back to me on 2-17-2012. But I strongly agree that we need to sue these jerks and at this point I won’t be happy with anything but a copy of my TITLE in my hand!! I think that BofA ‘s punishment should be to give everyone their house titles and they get to go pound sand up their asses!! They don’t deserve a penny from hard working people that are struggling to keep their homes.

I lost my job in 2010 and was on unemployment for 6 months.I sent Bank of America 30% of my unemployment for the mortgage payment at that time.I have been back to work for the past 11 months, making my 1800 month mortgage to Bank of America and hoping for a modification with them and save my house.I tried to make my mortgage payment in July 2011 and found out they wont accept my payment, and was given a notice that my house is going up for sale in Nov.Take my house not my payment and put my family out so that my house can sit empty for years and not take my payment, this does not make sense and is this legal?They want me to short sale, and said my house is not B of A its owned by a bank in New York.The paper work looks funny. I have had a BAC loan who took over my countrywide loan, funny thing is countrywide granted my modification, I was paying on it and BAC said we are not honoring it, you are paying 300 less a month than you are supposed to, so each month I was hit with a late fee. They were not posting my payments until I acquired the full amount so each payment was posted to the prior month, they never told me this until it was later and later. Then it was allegedly 12 months late even though I was paying the correct amount. I have been dealing with them BAC and NACA for 3 years, I have had approvals, and denials and closing dates. Now I am in foreclosure. They LIE LIE LIE. I am going to file a law suit because they will NOT be taking my home. I am a realtor in Indiana, working with clients who have not lived in their house for 3 years and BOA has not foreclosed on them yet. Meanwhile BOA has changed the locks on their homes, winterized it, and they have had to pay their HOA dues because they were going to be taken to small claims court. The title is still in my client’s name although BOA has been paying their taxes for the last year and a half. They are holding up the foreclosure and my clients want it to foreclose because they are unable to buy another house while they are on the title to this home. I am in a similar situation in PA. I just posted a comment explaining myself. We surrendered our home in bankruptcy awhile ago & haven’t made a payment in over a year but when I call they say that it’s still in default. My inlaws offered their rental home to us to live in for free but I am afraid to leave this one before they foreclose because it’s still in my name. BOA’s bankruptcy dept told me to call them when we are moving out so they can secure the home but it still worries me that it’s in my name. Why won’t they just foreclose already especially since I surrendered it in bankruptcy. I am wondering if I’m one of these lucky people that they lost the paperwork on when it was sold from place to place and now they can’t foreclose. Yes it’s happen to me. Lost sale on my house on sept 15 -08,, closing date was on sept 17- 08. They ruined the very industry in which I make the money to pay my mortage and ruined the sale, which would have paid it off. They file with court to forclose and there was no legal discription on the deed of trust. They put in their own version and re recorded it. Stopped that,, and now a year later they have filed again with same wrong legal discription. Taking me to court now. Meantime they locked up the house, changed over the electric, and the house is still in my name. I bail out B of A and they took my money and hire lawyers to take myself to court. Yes I’m paying someone to take myself to court. The local courthouse take’s their phony documents as real in every case. I have been trying to get a home modification loan do to hardshipsand I finally got it,but it only helped me by cutting my payment by 30.00 (thirty dollars) It’s a joke!!!!!!! my payment is supposed to be 2006.00 a month with the modification its 1969.00 a month. My salary is 3500.00 a month ,before my hardship I was making 8,500 monthly now it is 3,500.00 amonth, I submitted all of the correct information to BOA and thy came up with some crazy figure that I made 6,500.00 a month,I corrected them and they told me that they saw there error, but they did nothing about it.I just recieved my approval for the modification agreement,in the amount of 1,969.00 which I cannot afford. I thought that they were suppose to make it afforable,they don’t seem to be following the govt. rules for the (making homes afforable program)

Four payments we made for a total of $10,000 prior to and during our modification have not been applied to our loan balance with BAC. We have faxed in proof of the payments showing where BAC cashed our checks. We have contacted their customer no-service, managers, branches and their executive offices with absolutely no resolution. We have been in contact with our representative of congress and his office is getting the same run around. No one is taking an assertive approach to help us. How can we find out if there is a class action suit or similar legal action in Georgia. This has gone on for more than 2 years. Thanks in advance.

We stopped making mortgage payments to BOA in 2/2010 cause we just could not afford it anymore & they were jerking us around w/modification. In Oct 2010 we filed for bankruptcy surrendering the house as of today 8/26/11 we have still not been foreclosed on & are still in our home. I called their bankruptcy dept & the lady said she is showing us still only in default not foreclosure. Why is it taking so long? I’m not complaining but how do I find out if I’m one of these people that they can’t foreclose on because they don’t have the right paperwork? My mortage was sold several times before Countrywide got it & then BOA. I’ve heard of some people w/mortgages thru BOA that can’t be kicked out of their house because BOA doesn’t have the right mortgage papers so they people are pretty much free to live in it. We’re not sure what is going on & have another place to move to but I am afraid to leave the home when it’s still under my name. If I am one of these few that’s paperwork got lost & they have no intention of making me leave, I may just rent the house out on a month to month to a friend.

I’m even more discouraged after reading all of these comments! I am also in this loan mod nightmare with BAC and have been trying unsuccessfully to get a loan mod or forbearance since Feb 2009. I was denied for making too much money, not making enough money, not sending the paperwork on time (although I had informed them when my paperwork was sent and they said that it was fine), for being on unemployment even though I wasn’t on unemployment!
Today I was visited by a 3rd party affiliate to discuss my options and his advice to short sale. I am in tears…I have done everything asked of me, I have rented out rooms in my home to increase my income, I have sent every piece of documentation requested numerous times and followed up with calls each time and in between. I am a single mom and my youngest as Asperger Syndrome. Not only is life already stressful, he does not deal well with change so having to move into a small apartment, or move at all for that matter, will be extremely traumatizing to him. I really don’t know what to do…I continue to make monthly mortgage payments and I’m asking for a workout for the months I had missed and the late fees.

I am in the state of Georgia. I was working with a Hud counselor when they forclosed on my house I sent well over 100 documents to BOA. I was turned down for a modification saying I did not turn in the required documents. I have been given the run around so many times. I have went to foreclosure seminars spoken to so many different representatives. They said they were going to do everything then can to help me. Never gave me a modification, never gave me a dollar figure for a repayment plan or anything.
Bank of America also gave me the run-around when I attempted to get a loan modification. They Foreclosed on my home with out serving me notice when I was out of town and returned from a business trip. MY possessions are inside the house which I have been unable to retrieve. I too live in the state of Georgia. If you have any info on joining a class action against BOA in the state of GA, or know of a good attorney, I would like to know.

Well, they took my home, I did the modifications, I jumped through their hoops! I did the making home affordable program and was foreclosed on anyway. My house sold at auction for 18 thousand dollars. I am homeless.

B of A is also playing games in Maryland. They advised me that they will no longer accept partial payments for my mortgage. In the month of September alone I sent two payments totaling more than what is due for my mortgage and they sent them back to me. I called them and they informed me that no longer accept partial mortgage payments (keep in mind I have sent the partial payments in the past and it was not a problem). I advised them to send me that in writing and was literally told by them that it was in my loan documents. I advised them that my documents were in front of me and it was not in there. Then the representative advised me that she could not send me anything in writing on that fact. Also, I am getting screwed by them regarding a home equity loan modifiaction that they initially stated I was approved for. I was advised by the rep to fax all of the requested paperwork and to call them often to check on the modifiaction status. I faxed all of the required information and called as I was instructed. After several weeks of calling and not being unable to reach the representative that told me to call him I received a notice stating that the process is being cancelled because I did not send the paperwork as required. Obviously B of A thinks I am an idiot. I recorded every phone conversation and keep all records including documentation of the faxed paperwork. I am filing suit ASAP!!!!!!!!!!!!!!!!!!!!!!. I am so upset at the government for literally giving those crooks money and not holding them accountable for screwing over the american people. The government should just let them (B of A) crash and provide the american people with government owned loans to help the american people in this countrywide financial crisis.

This happened to me! Anyone know who to contact in Indiana??? I had to file ch13 bankruptcy 1 day before sheriffs sale because BOA would not return my phone calls.. Sent them all the paperwork they wanted, only to be told that i havent even started the process! Just found out this information from a friend that is dealing with an attorney to stop her foreclosure. Banks receive a payment of $1200-$1400 (from HAMP) EACH time you send out your papers to their companies. NICE right!!! I would loose your papers too!!!!!! (this is just my opinion)
Hi, your friend is incorrect. I have my mortgage through BOA, however I work for another bank in the Loss Mittigation Dept. HUD ( a HAMP is a version of a modification tht is part HUD & part regular mod) only sends the money ONCE & only pays the amount that is in the arears. Most banks go ahead & front the money to themselves out of another account & once HUD pays they put the money that was fronted back in the account. I do not know how BOA operates their Loss Mit dept but most of the banks all operate on the same premise…

Well they got me. No matter what paperwork they asked for, I submitted them, the end result was I still did not make enough money for them. I would think that if I was willing and able to pay something 700 – 800 a month they would be willing to neg, but no, each and everytime they just continue to ask for more and more paperwork, not to mention each and everytime you called you would receive a different reply.

Bank of America keeps buying and cancelling flood insurance on my property even though I have my own policy. Now they raised my payment from $379 to $886 a month, because they say my escrow account is $3000 in the negative. They are threatening to foreclose on me. I need an attorney. I live in Davenport Iowa. Ive lived in my home for yrs and only $500 has come off my principle, the rest going into Bank of America’s pockets. Im self employed, therefore cannot document my income so they say I dont qualify for any programs. They want $4700 to get my house current. They include so many fees, property inspection, foreclosure lawyer, foreclosure fees. Someone please help me.
I am 8000 in the hole with B O A. I am trying to do a modificaion with them right now. The dumb lady assigned to my account never calls back. This month i did not gey a statement and now my payment is late. I do not know what to do. I don’ t want to loose my home, but after reading all of this i’m really unsure of things. I have even tried sending extra money monthly, but they just send it back. Does anyone know if filing for chapter 13 save your home? Any suggestion would be appreciated. I live in NE.
BOA started the foreclosure in 2007, They made us jump thru hoops for months for a modification. They supposedly bought our loan from Countrywide who bought from Amercian Brokers Conduit. In the foreclosure papers its Bank of New York that is serving foreclosure papers. So freaking confusing.
We went to an arbitrator to settle and the lawyer for the bank never showed up, had improper documentation for the transfers.
Now 4 years later BOA sends a letter to leave our home in 30 days and they are trying to take our contiguous 60 acres to boot!!
Last month I received a check for $107 from BOA as part of the class action settlement. I deposited the check omly to have it bounce and returned.
We need to join forces to fight these bullies and force them to refi our homes to their current values and let us begin anew just as they did with our bailout money!

My nightmare with Bank of America’s Making Home Affordable Program started in March 2010.
2009 was devastating for the construction industry and many of us began to struggle and fall behind.
I managed to scrape by until the spring of 2010 when my saving, pension and unemployment ran out.
After becoming 2 months behind ($2800) on my mortgage I received “Notice of Intent to Accelerate”. Shortly afterward I received a mailing informing me that I was selected to participate in the Making Home Affordable Program and to start paying a reduced mortgage payment.
Of course I thought this was great!
I found a new job about the same time and felt confident I would be able to make the trial payments on time.
My old payment was about $1400, the new payments where about $850.
My old jobs paid above $25 per hour, my new job paid $18 per hour plus overtime but is more seasonal. I only work 9 months of the year at the new job.
Bank of America would ask me periodically to update my financials during the program.
After 8 months of paying into the program I received another “Notice of Intent to Accelerate” The notice stated that I now owed over $8,000 dollars.
I was shocked!
At the outset of my being entered into the program I was unaware, that if I was denied my modification, I would be held liable for the balance of the reduced payments. This includes miscellaneous charges and fees.
It was never stated over the phone or in writing that this would be the consequence.
This program has turned from an opportunity to help the struggling homeowners struck by corporate greed, into the final devastating death grip of predatory lenders.
The modification evaluation process is done behind “closed doors”. These decisions are devastating to 80% of the borrowers whom have entered into these programs.
At the very least the bank should be required to send the Net Present Value (NVP) report used to determine their denial to the mortgage holder. The mortgage holder shouldn’t have to request it. The bank most likely has destroyed it anyway.
If anyone out there can help, I need you! The deputy delivered foreclosure papers to us yesterday on our mortgage. Thing of it is, we refinanced in December with another bank and Bank of America states on phone we don’t owe them anything. I’ve been through a long period of fights with BofA and finally decided to try my local bank for a new mortgage. It worked. I thought I was done with BofA. Yet, now they want my house! I need an attorney to fix this and countersue for damages!!!!!
Get your bank to send proof that they paid off your debt to BofA and also contact your STATE ATTORNEY GENERALS OFFICE right away!!
Today, dated Dec. 25 , Christmas Day I received yet another letter saying I need flood insurance…That make 8 different times, with 8 different amounts of flood insurance that they are buying on my property. Which makes my escrow account in he negative.
They are ruthless and out of control.

I lost my job of 13 years 3 years ago and my husband and I were going through s financially difficult time living off of my little unemployment plus his pay. I was the head of household at the time. For 7 years we made EVERY pmt on time. Things became difficult and we became slipping further and further behind in payments. Received foreclosure notices, act 91, etc.. I filed for modification and of course, the ALWAYS said I was missing documents or they were lost and needed to be re faxed. The bottom line people I have NOT MADE A SINGLE MORTGAGE PAYMENT in over 18 months and I am still receiving monthly payment coupons to mail my mortgage payment. I was told at this point, even if I resumed making payments on time as I was able to find gainful employment 10 months ago where I can now afford the home, BOA said there is no guarantee that by making current payments now will stop any further proceedings in the future. I bet you they don’t have the original documents from countrywide when they acquired my home loan and legally without the original copies(I am a lawyer) they are unable to proceed….
Do you know how we can find out if this in fact true? I also was with Countrywide, live in MD and suspect they may not have my original loan documents as well. Please write back.
I have the same situation like you.I live in Illinois.In 2008 me and my husband lost the jobs.From 2009 we sent the papers to BOA for a loan modification, but they never did anything for us.We have so many papers from them telling us they received all the papers and to wait 20 days for an answer,but after a month or more they asked for other papers with 24 hours deadline,and they did nothing,just stressed us out.
They put our house in foreclosure.
In January ,2012 we received a letter from BOA via FedEx,and they was asking for tax return,deadline March 3rd,2012;but today my husband went to BOA’s lawyer office and they said our house was sold on February 8th,2012 to BOA,for $435000,and our loan is 1000000.
Two weeks ago we received another letter from BOA,dated February 10,2012,and they said ”We received your request regarding a loan modification on the above-referenced loan and forwarded your request to a specialist in the appropriate department.After the necessary information is reviewed,we will respond to your request.”
What we have to do now?
We asked to many times to lower our loan and start to pay,but last month they said if we want to pay, our monthly payment will be higher than before.
We want to sue BOA,but we don’t know if this is the right thing.Can any one help us with some information please!!!
We where transferred to another state tried to sell our home for 2yrs. BofA has our mortage loans 80/20loans , We tried to get modifacations, we cashed out 401 in hopes not to loose big on house. Well came to point we stopped paying had offers os short sale BofA wouldnt get back with us or realtor we followed all proceedures and still no one did anything! They foreclosed with in 1yr and was auctioned and who bought house??? BofA!!! for $100,000 less than we owe! the short sale would of saved us the huge negative! I feel this was there plan all along now they will collect plus resell for lots more!! I am so upset and have no where to turn! If anyone doing suit please contact I want in!!
I was hurt and not able to return to work BofA said they would work with me on a home loan mod. it was only 10 days tell auction when they stopped the auction because they got the numbers they wanted to hear. Then when i got my first mortgage statement it was higher then the normal payment they lower the interest payments but put on thousand on the tail end of my loan making my payment more then it was before if i could not afford it before how was i going to do it now. I paid two months then i could not keep it up anymore. Then they did talk to me for 6 months about my loan then they tell me i have no option but to get out. It’s now been 18 months and they finally sent me more paper work to try and mod my loan again but the fine print says you are pretty much doomed on keeping your house is there a class action lawsuit in Idaho that i can join? Can anyone help me with this? If they take my house they will be lucky to have windows in it when they show up after the way they have treated me. Any direction i can go in would help don’t want to lose our home.
I live in the non recourse state of Arizona we decided that we would rather walk than pay for a house we would still owe money on late into our 80′s with no end in sight. Our first foreclosure was supposed to be in November 18, 2010 nothing ever happened just sat there. Then in July of 2011 we got notice that they changed their minds this was after the original foreclosure was supposed to take place. Then in September they once again sent us a letter of foreclosure it was supposed to be on December 21, 2011 didn’t happen either or at least we never received any notice. And our name is still listed as the homeowners in the county website. This should have been done and over yet they continue to drag their feet. I am tired of their bull we had initially asked for a modification and then a short sale they denied us both. That is why we decided to walk. For the modification they said we were too upside down. For the short sale they wouldn’t even send us the paper work unless we already had a buyer. r feet. I am too old to put that much stress on myself I would rather live longer and not think about a bank who thinks nothing of me.
We are in the same boat to! Seems like this bank really needs to go down. We stated the mod back in Sept. we can’t seem to get anyone for Bank of America to listen to us. I have been sending them monthly payments but our past due balance keeps getting higher. We can’t afford an attorney and it sounds like we should get one ASAP. I don’t understand how they can get away with this! If there is a class action lawsuit in IL sign me up. Anymore that is all you read about online is horror stories about foreclosure horror stories. Lucky, they get resolved. I have went as far as contacting the FTC, Consumer Affairs, Attorney General, local government. Next on the list is the CEO of Bank of America and the BBB.org.

My original mortgage was with Countrywide. For years, our payments were always on time and there were never any problems. Then, my husband became disabled and I was laid off for 7 months. After I went back to work, we decided to refinance, in an attempt to catch up on a lot of bills. The local Countrywide office kept telling me they were having trouble getting the refinancing approved, as our income didn’t look like enough money. The lady that was helping us kept asking me to be patient. She said she knew someone that was on vacation that would sign the paperwork when they got back in the office. Sure enough, the person got back and our refinance was approved. After a while, we started getting behind, as the new amount was more than our original mortgage amount has been. At this time, our loan had been bought by BAC. Additionally, I was paying my own homeowner’s insurance and taxes, which I didn’t do in the original mortgage. Last November, I sent in two payments, and my payment was returned. I tried resubmitting it and once again, it was returned. At that time, I was told on the phone that my loan was in default and in foreclosure. It’s now a year later and I have never heard a word from BAC since January 2011. I have been saving the payment amounts in a savings account every month. I have sent in modification paperwork three times and have never heard a word from them.
I was talking to a government audit specialist a few weeks ago and told him about my situation. He said there is a huge problem with Countrywide approving people for loans, knowing their income wasn’t high enough to make the payments. They had people that would approve the loans, knowing the people couldn’t afford to make the payments. I think this is what may have happened in my case.
Also, there were several times that BAC would bill me for homeowners insurance and then I would have to contact my insurance agent and have them send paperwork to BAC, showing my insurance was paid and in effect. Supposedly, BAC would then refund overcharges to my escrow, but not sure if that ever happened.
Two weeks ago, I sent in a request to the Independent Review Commission, asking them to audit my account. I listed the above discrepancies in my application. I got a letter this week that the Review Commission would be looking into my paperwork.
Does anyone have any suggestions on what I should do next? I’m in Florida and am more than willing to join any and all class action suits against BAC.
After 3 years of trying to work with B of A, and paying our mortgage for all but three payments in 2009 we are being foreclosed. Sale date is 2/27/2012. We have tried everything and are still taking a few steps. This process has really taken its toll.
Hello, this is an old timer named Margo La Bayne. Bank of America foreclosed on my home illegally on March 18th 2010. If you were also foreclosed on go to the Attorney General US dept website . call them and contact the Housing and Civil Enforcement department , there you can sign up for a refund of at least $2,ooo.oo. You will not lose your rights for a civil lawsuit against your lender this is just monies put aside from Bank of America to people they foreclosed on. We are seeing great things happening to those lenders that did what they wanted to do without regards to the law. Sincerely,

I have been fighting this fight for a little over a year and a half! I did the HAMP program, the HARP program and finally the Hardest Hit program. I have a court date in Nov 2011 I was told the group designated to handle my case would get the courts the appropriate documents and I didn’t need to show up. Well I received a notice telling me I failed to show up for court and they entered a summary judgement against me for default and my house was going up for sale Feb 20th. I can’t go another day physically ,mentally and emotionally sick. I can’t eat I can’t sleep and I have no place to go and no money to get another place to live. I do not want myself and my daughter to have to live in a shelter while my home of 14 yrs sits empty. If not for my daughter and my family Bank of America has made me so weary ending life doesn’t look so bad!
BoA needs to be shut down!!! I submitted all of my paperwork back in Aug 2011, received a letter from BoA that they had received my paperwork and would review and respond within 28 days, that was Sept 2011. I have not heard a word by phone or mail. I have mail numerous call to BoA only to be transferred around to voice mails. I have left numerous voice mails with no call backs on that status. I have even called the manager…no response, even though their voice mails state they will call in 24 hour…what b/s.
How is the gov’t letting this happen to so many people when all we want is to keep out homes and live a normal life as much as possible and provide for our children a normal life???!!!
I refuse to send any money to BoA with everything I have read until I hear from them. I have not received a foreclosure notice as of yet, but everyday I expect it. You would think with so many homes that are setting empty from families that have suffered BoA would help and those families that did lose their homes shouldn’t have in the first place!!!!! Everyone else received a bail out…what about us ?????!!!!!
I only had my house for a year 1/2 and not only that I was paying insurance . But the bank of America did not want to help me even thought my husband was laid off and I became sick . We fell behind but still they foreclosed . I feel so violated by bank of America. To find out that this happened I dont know what to do ????
I am in the same prdictament as many of you. BOA has scewed us out of the mondification as well and now we are getting letters of intent to forclose. I want to know if there is a class action suit. I live in Tennessee. Please help us! We have a year old and no where to go.
I have been dealing with BOA for over 2 years now on trying to modify my loan. They denied my first two and told me that I qualify for another loan modification so I applied again. After 7 months now I still have not received my modification papers and when I talked to them today they said they do not have any documentation of why it wasnt sent so they said they will make sure a supervisor sends one out in the next two weeks. Meanwhile I havent made a payment in over two years and all they keep doing is calling me and keep harassing me every day. I am looking into having the loan looked at to see if they really did loose all the paperwork when they bought out Countrywide home loans. Any suggestions?
boa should be ashamed of themselves. according to lawyers i’ve talked to boa is pulling the wool over our eyes. i’ve submitted paperwork since aug 2010 with no resolution. i’m currently in “underwriting” but get this, my case manager has ceased all contact with me. i’m making my full payment and the attorney i talked to said, WTF would you do that? boa will never modify your loan if your making the full payements. i’ve sold vehicles to try and save my house. i’m going the atorney route and let them battle boa. they’ll keep dicking me around if i don’t take control. my situation was real, loss of income that’s documented. i’ve never been late before in my life. i’m going to apply my mortgage payment to the lawyer fees. get ready boa, you’ll restructure my loan now whether you want to or not. i suggest everyone do the same and bring this monster to it’s knees.
I was a first home buyer and received 2 loans from BofA. I was only 23 and BofA totally took advantage of me. I agreed to payment of $900 a month and told them that was the max that I could go. BofA agreed and said that they could work with me and I received my loan with the agreement that I had to have a $30,000 down payment which they would provide me another loan for. I asked if my payments would still only be $900 a month and they told me yes. I signed the papers and within 2 weeks I received my payment book. The total amount due was $1,500 a month! I immediately called BofA and they jerked me around stating that I needed to call their corporate offices in Florida and that their bank which gave me the loan couldn’t help me! I called Florida several times and got no where. They continued to tell me that the bank in my home town where I received my loan are the only ones that could help me! They were just blaming each other and no one ever helped!!! I couldn’t make the entire payment. I tried to make what I could but, they refused my payment saying that they could only take the full amount due and they were not allowed to take anything less! This is just stupid!!! Long, long story short…..they sent me home loan modification papers which I filled out and sent in several different times because they said that they never received my paperwork then, finally after 6 months they denied my home loan modification. So, here came the nasty letters and foreclosure threats. Finally, they sold my loan to Saxon Mortgage around a year ago. I received their paperwork and have been working with them to try and get my loan to where I can afford it. Yesterday, I received a notice from some lawyer that works for BofA that my home will be up for public auction in 2 weeks!!! I still have my first loan through BofA and have always been on time with my payments and my second loan was sold to another mortgage company. So, how in the world can BofA sell my home from underneath me like that??? I’m super scared and can’t lose my home. I thought that everything was taken care of and I wouldn’t have to worry about this stupid bank taking my home anymore! Please help if you can. Any advice would really be appreciated or if you’ve been in this situation please, let me know how it ended for you. Thank you.

then 6-7 months ago got an opportunity for a HAMP Loan Mod.Review. Still going
through,or though they say, but now lo and behold I get a letter with a foreclosure
sale date!!

I was with Willshire Mortgage and was approved for a Loan Mod and my first payment was to be made 02/2009. 02/2009 I wen to their website to make my first payment and was redirected to a page that said BOA had acquired Willshire mortgages and to call this number. I did and was told I could not make a payment until BOA had “boarded” my mortgage into their database and to call back. . I called every week and was transferred between departments, etc and at the end of each call was told to call back. Then out of the blue in 11/2009 I get a foreclosure and sheriff sale notice. I hired an attorney firm who worked with me on getting the sale stopped and start a new Loan Mod application with BOA, etc. My case has been in BOA hands since then, I have had to resubmit the application several times, etc. Now 03/2012 I still do not have a completed Loan Mod. I have been told my file is in underwriting for months now. I just learned there has been another sale date placed for 05/2012. I am looking for other options am loosing faith in the attorney firm representing me. I do not see why it could take this long. I simply want my loan mod to be done and start making mortgage payments and keep my home. Anyone out there have any info for me? Any suggestions/guidance/etc? I did find this article about homeowners in Texas who sued BOA. It has been 41 yes 41 months since I made payment. I have jumped through all of bofa hoops that were all lies. I provided six months of paytubs showing net income LESS than my mortgage payment and was denied loan modification due to “no financial hardship” after I lost my job.
Twice I have had papers sent to me for foreclosure dates and NOTHING has happened , if and when I call bofa THEY CAN’T tell me why my foreclosure does not go through. I call the attorney that is handling the foreclosure and they don’t know why it does not foreclose. I have moved put and think I just should just rent my house out for dirt cheap and pocket the cash at their expense. This is a cluster ffffuuuuccc if I have ever seen one.
I have my home loan with B O A . And im a general contractor and when work started to slow down i called B O A and let them know what was going on and i had enought money to make my payments for a couple of years. but i need some help, thay told me that the only way they could help me was for me to become 3 month past due. and with that giving them all my info they said that their was no problem getting a loan modfication. well after a year they rejected all of my applications. now my credit score became bad and now the board of contractors denied me my lissence this last year. Now i have had a very hard time being able to make money.
I would love some help with this if anyone can help me.
